1. Description of Service

NutriAI is a nutrition tracking application that uses artificial intelligence to analyze food photos, provide nutrition information, generate inflammation scores, and offer coaching based on an anti-inflammatory framework. The app is intended for general wellness purposes only.

3. Subscriptions and Payments

• Free Tier: New users receive 3 free scans a day for their first week of use, then 3 more scans after that window closes. After those a subscription is required for continued scanning.
• Premium Subscription: Monthly or annual plans. Pricing is displayed in-app before purchase.
• Free Trial: 7-day free trial. If you do not cancel before the trial ends your subscription begins and you will be charged.
• Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Billing: Purchases are billed through the Apple App Store (iOS) or Google Play (Android), depending on where you downloaded the app.
• Managing Subscriptions (iOS): Manage or cancel in Settings > Apple ID > Subscriptions.
• Managing Subscriptions (Android): Manage or cancel in the Play Store app > Profile > Payments & subscriptions > Subscriptions.
• Refunds: Refunds for App Store purchases are handled by Apple per Apple's policies; refunds for Google Play purchases are handled by Google per Google Play's policies.

4. Accuracy of Information

Nutrition information produced by AI analysis is an estimate. Actual values may vary with preparation, portion size, and specific ingredients. Barcode data is sourced from Open Food Facts and may not always be current.

5. User Responsibilities

• You are responsible for the accuracy of the information you provide (height, weight, goals).
• You agree not to use the app for any unlawful purpose.
• You agree not to reverse engineer, modify, or interfere with the app's functionality.

6. Intellectual Property

The app, including its design, features, and content, is the property of Quantivo AI, LLC and is protected by applicable intellectual property laws.

7. Limitation of Liability

To the maximum extent permitted by law, NutriAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim.

8. Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms.

9. Apple's Standard EULA

This app is also subject to Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

10. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing Law

NutriAI is operated by Quantivo AI, LLC, a limited liability company formed in the State of Delaware, United States. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, and the state and federal courts located in New Castle County, Delaware have jurisdiction over any dispute arising from them.

If you live in the European Union, the United Kingdom, or another jurisdiction whose consumer-protection laws cannot be waived by agreement, nothing here removes rights you hold under the law of the country you live in, and you may bring proceedings in your local courts.
